Propriedade e a moradia na regularização fundiária: Brasil e Portugal

Abstract

O presente trabalho propõe-se a analisar a proteção jurídica do direito fundamental à propriedade e à moradia/habitação nas regularizações fundiárias no Brasil e em Portugal, através dos instrumentos jurídicos existentes para a regularização de suas áreas ilegais e irregulares. A moradia/habitação e a propriedade são direitos humanos, constitucionalizados nas Constituições brasileira e portuguesa como direitos fundamentais que devem ser garantidos a todos os cidadãos. Também nos dois países a crescente urbanização que intensificou-se diante do processo de industrialização ocorrido no século passado, não foi planejado, dando margem ao surgimento de áreas de ocupação desordenada e ilegal, onde as moradias são construídas sem autorização do poder público competente, e não raramente sem instalações sanitárias, de água e energia elétrica, sendo elas ilegais ou irregulares tanto do ponto de vista jurídico e urbanístico, quanto por suas condições de instalação, segurança e conforto. Por outro lado, a posse sobre o imóvel também é, em geral, conflituosa, pois muitas vezes não existe relação jurídica entre o proprietário do terreno e o ocupante do imóvel, ou, quando existe, pode ocorrer que a ocupação da área para moradia não tenha sido autorizada pelo município, como é o caso dos loteamentos clandestinos e irregulares. Os moradores destas áreas, inevitavelmente, encontram-se num contexto de exclusão social, pela inexistência de infra-estruturas e equipamentos e pela incapacidade de adquirir um imóvel no mercado formal. Com o objetivo de combater a difícil realidade que se apresenta no contexto urbano, tanto Brasil quando Portugal adotaram mecanismos de regularização das áreas ilegais, objetivando identificar os instrumentos jurídicos de proteção da moradia/habitação e propriedade enquanto direitos fundamentais.

This study proposes to examine the legal protection of the fundamental right to property and dwelling in agrarian land regularization in Brazil and Portugal through the existing legal instruments to deal with its illegal and irregular areas. The dwelling and the property are human rights constitutionalised as fundamental rights in Brazilian and Portuguese Constitutions, which must be guaranteed to the citizens as a whole. Also in both countries, the increasing urbanization that has been intensified in face of the process of industrialization occurred in the last century, wasn’t planned, leading to the emergence of disorderly and illegal occupation areas where homes are built without the responsible public power authorization and frequently with no toilets, water and electricity, everything illegal or irregular on legal and urban point of view and so per its terms of installation, safety and comfort. Therefore, the property possessions are also, in general, confrontational, because generally the relationship among the owner of the land and the occupier of the property doesn’t exist, or, when it does, it’s possible that the occupation of the housing area has not been authorized by the local authority, such as the illegal and irregular lots. People who live on these areas are, inevitably, in a context of social exclusion by the lack of infrastructure and equipments, and so by the inability to acquire a property in the formal market. Aiming to tackle the difficult reality present in the urban context, Brazil and Portugal have adopted mechanisms for regularization of illegal areas to identify the legal instruments of dwelling and property protection as fundamental rights.
