A nova lei das finanças locais e os seus impactes

Abstract

A evolução das Finanças Locais ao longo do tempo levou a que se fizesse sentir necessidade de efectuar alterações na legislação aplicável às Autarquias Locais de modo a suprir lacunas existentes. A Lei n.º 42/98, de 6 de Agosto que esteve em vigor até 31 de Dezembro de 2006, não foi excepção e como tal, após a sua aplicação e evolução no tempo, apresentou lacunas para as quais houve necessidade de as resolver. A solução surge na Lei n.º 2/2007, de 15 de Janeiro. Assim tornou-se essencial analisar quais as principais alterações introduzidas relativamente à lei anterior. Procurou-se verificar as mudanças operadas, ainda que a análise tenha sido realizada no ano de transição da legislação. Com esse objectivo far-se-á uma análise geral para o Distrito de Aveiro, sendo que a análise e conclusões incidirão sobre dois Municípios distintos do Distrito de Aveiro, geograficamente próximos.

The evolution of local finance over time meant that there was a need to make changes in the law on local authorities to address gaps. Law No. 42/98 of the 6th of August that was in force until 31st of December 2006, is no exception and as such after its implementation and evolution over time, had gaps for which there was a need to tackle. The solution comes in Act 2 / 2007 of the 15th of January. Thus it became essential to examine the main changes made to the law. We sought to verify the changes made, although the testing was completed in the year of transition legislation. With this objective there will be an overview for the District of Aveiro, and the analysis and conclusions will recount to two different municipalities of the District of Aveiro, geographically close.
