Queering public policy: the LGBTQ movement influence on policymaking in Brazil

Abstract

After the Brazilian democratisation in 1985, the LGBTQ movement deployed several strategies to influence the legislature to approve an LGBTQ bill in Congress but failed. Given the legislative inertia, the LGBTQ movement shifted strategies and venues of activism from legislative to executive and later to the judiciary. The federal executive and judiciary have created palliative policies to compensate for the legislative vacuum and tackle LGBTQ issues, particularly anti-discrimination policies. Therefore, this research raises the question: how does the LGBTQ movement influence policymaking in Brazil? By analysing the anti-homophobia policy process that started in 2001 in Congress and concluded with a judicial decision in 2019, this dissertation seeks to unpack a causal mechanism of influence between the LGBTQ movement and policymaking in one of the most violent countries for LGBTQ people globally. The interplay between social movement, public policy and queer theory helped investigate the movement-policy relationship in a Global South case study. Using data triangulation – document analysis, semi-structured interviews and Court cases analysis –allowed us to identify and analyse actors, events, decision-making, instruments and strategies driving the mechanisms of influence in the policy process.

Após a democratização do Brasil em 1985, o movimento LGBTQ implantou várias estratégias para influenciar o legislativo a aprovar um projeto de lei LGBTQ no Congresso, mas falhou. Dada a inércia legislativa, o movimento LGBTQ mudou estratégias e espaços de ativismo do legislativo para o executivo e depois para o judiciário. O executivo e o judiciário federais criaram políticas paliativas para compensar o vazio legislativo e abordar questões LGBTQ, particularmente políticas antidiscriminação. Portanto, esta pesquisa levanta a questão: como o movimento LGBTQ influencia a formulação de políticas no Brasil? Ao analisar o processo de política anti-homofobia que começou em 2001 no Congresso e foi concluído com uma decisão judicial em 2019, esta dissertação busca desvendar um mecanismo causal de influência entre o movimento LGBTQ e a formulação de políticas em um dos países mais violentos para pessoas LGBTQ globalmente. A interação entre movimento social, políticas públicas e teoria queer ajudou a investigar a relação movimento-política em um estudo de caso do Sul Global. A triangulação de dados – análise documental, entrevistas semiestruturadas e análise de processos judiciais – permitiu identificar e analisar atores, eventos, tomadas de decisão, instrumentos e estratégias que direcionam os mecanismos de influência no processo político.
