Gestação de substituição. Direitos ou deveres adquiridos das mulheres?

Abstract

Neste artigo aborda-se a Lei de gestação de substituição que entra em vigor em Setembro deste ano, em Portugal. Apresenta-se a proposta criada pelo Bloco de Esquerda, bem como as tomadas de posição dos restantes partidos políticos, de órgãos consultivos independentes e das Associações de defesa dos direitos humanos. Tendo sempre presentes os direitos fundamentais da mulher, discutem-se ainda as consequências desta técnica de reprodução na vida das mulheres portuguesas. Este trabalho tem a pretensão de contribuir para a compreensão e aprofundamento de conhecimentos sobre a gestação de substituição numa Europa que tem como bandeira a defesa dos Direitos Humanos e que pretende eliminar a discriminação e violência contra as mulheres e crianças.

This paper discusses the law of gestational surrogacy, which comes into force in September of the current year, in Portugal. It presents the proposal created by Bloco de Esquerda, as well as the positions of other political parties, independent advisory entities and Human Rights Associations. Always keeping in mind the women’s fundamental rights, it is still discussing the consequences of this reproductive technology in the Portuguese women’s lives. This work intends to contribute to the understanding and increase knowledge about gestational surrogacy in Europe engaged in the defence of human rights that wants to eliminate all forms of discrimination and violence against women and children.
