Os governos constitucionais e a proteção social da criança

Abstract

Até ao século XIX as fragilidades da Criança não eram reconhecidas, sendo que se assistia ao tratamento igualitário entre estas e os adultos. Contudo, somente a partir do século XX lhe foi reconhecido o estatuto social de vulnerabilidade e necessária dependência. Desta forma, sob uma maior intervenção do Estado na esfera pública, foram produzidas várias medidas capazes de dar resposta aos direitos da Criança no que toca à provisão, participação e proteção. Porém, ao longo dos seguintes anos assistiu-se em Portugal a vários avanços e retrocessos nas medidas e legislação produzidas assim como na sua implementação. Desta forma, o presente trabalho pretende perceber quais foram as posições adotadas pelo Estado, mais concretamente pelos dezanove Governos Constituionais que presidiram desde 1976 em Portugal, face à temática da Proteção Social da Criança. Partindo dos pressupostos defendidos pela literatura que se apoiam numa Esquerda mais Social e numa Direita mais ligada à Economia, pretende-se demonstrar que os Governos Constitucionais de Esquerda atribuem uma maior importância à Proteção Social da Criança, ainda que ao longo do tempo a Direita tenha vindo a revelar uma crescente consciencialização da necessária intervenção do Estado, o que é verificado a partir do estudo de subsídios e outras prestações sociais

Till the nineteenth century the flaws concerning the Child were not recognized, as we were used to witnessing the equal treatment between them and adults. However, only in the twentieth century was recognized its social status of vulnerability and necessary dependence. So, under a greater State intervention, were created measures to bring answers to the Children Rights regarding provision, participation and protection. Nevertheless, over the years we have witnessed, in Portugal, to several advances and setbacks concerning measures and legislation as well as in its implementation. Accordingly, this study aims to understand what were the positions taken by the Government, more precisely by the nineteen governments that presided in Portugal since 1976, address the issue of Child Social Protection. Starting from the assumptions supported by literature, that rely on one hand in a more Social “Left” and in the other hand in a “Right” flank more related with the Economy, it is intended to demonstrate that the Constitutional Governments associated to the “Left” attach greater importance to the Welfare of the Child, although over the time the “Right” has been revealing a growing awareness of the need for State intervention, which could be verified through the assigning of allowances and other social benefits
