Abstract: | Creating a framework for understanding law in China by scrutinizing the role of
law in China and using contract law as a barometer for the qualification of legal
developments is the main aim of this thesis.
The special characteristics of the historical, political and cultural factors that
determine law in China have until now produced a legal system that prima facie
resembles that of Western countries. However, the underlying principles of
authoritarianism, instrumentalism and utilitarianism that guide this process are
nevertheless contradictory to governing the country on the basis of “rule of
law”.
I argue that these underlying principles of authoritarianism, instrumentalism and
utilitarianism that guide the current legal reforms are not new but build on
historical roots. As such and against a background of traditional concepts
toward law these principles are examined in the official legal culture in the
Maoist and Post-Mao period using the institute of contracts as a test case.
Also, in the chapter about local legal culture, the popular assumption of these
regime ideals is examined.
In a separate chapter the difficult relationship between law and policy is
analyzed with the Tiananmen massacre as a litmus test for the establishment
of law. Also, attention is given to the globalization trend and pressure on law
and contracts in China.
In the conclusion the link between law in temporary China and the underlying
traditional influences is reiterated and after evaluating the level of
generalization and interpenetration of officially proclaimed law in a modernizing
Chinese society the position of the Chinese Communist Party versus the future
development of law is discussed. The globalization trend and the continued
reliance on the traditional principles in the creation of a legal system have,
instead of harmonizing alienated the official and local legal culture resulting in a
huge gap between “law in the books” and “law in practice” which in the end
could seriously impede china’s economic growth. Criar um quadro de referência para compreender o direito na China, indagando qual o papel que aí tem desempenhado e utilizando o direito dos contratos como barómetro para a qualificação da evolução jurídica constitui o propósito desta dissertação de mestrado. As características especiais dos factores históricos, políticos e culturais que determinam o direito na China deram origem a um sistema jurídico que prima facie se assemelha ao sistema jurídico vigente em países ocidentais. Porém, os princípios subjacentes de autoritarismo, instrumentalismo e utilitarismo que têm orientado o processo de reformas legais são contrários ao governo do país segundo as regras do Estado de Direito. Autoritarismo, instrumentalismo e utilitarismo não são princípios novos, antes se alicerçando numa longa tradição histórica. Tendo como pano de fundo conceitos tradicionais de direito, será abordada a presença destes princípios na cultura jurídica durante os períodos maoísta e pós-maoísta, servindo o instituto dos contratos como referencial. No capítulo sobre cultura jurídica chinesa, serão discutidas concepções populares sobre quais os ideais prosseguidos por estes regimes. Num outro capítulo, será analisada a difícil relação entre direito e política, onde o massacre de Tiananmen terá sido um derradeiro teste para a aplicação do direito. Será também dispensada especial atenção às influências da globalização e à pressão exercida sobre o direito e os contratos na China. Na conclusão, a ligação entre as várias influências tradicionais subjacentes é reiterada e, após uma avaliação do nível de generalização e inter-penetração da lei oficial numa sociedade chinesa em mutação, será discutida a posição do Partido Comunista Chinês perante a futura evolução do direito. A coexistência de tendências globalizadoras com o recorrer continuado a princípios tradicionais na criação de um sistema legal tem, em vez de harmonizar, alienado a cultura jurídica oficial da local, resultando numa enorme discrepância entre o “direito dos livros” e o “direito da prática”, no que poderá constituir um sério obstáculo ao crescimento da China. |
