A comissão de recursos do subsídio de desemprego

Abstract

Este trabalho visa estudar a Comissão de Recursos, criada pelo regime jurídico do subsídio de reparação da eventualidade de desemprego, aprovado em Novembro de 2006 e em vigor desde o início de 2007. Correspondendo a uma maior exigência de cumprimento de deveres por parte dos desempregados subsidiados, o legislador criou uma estrutura de análise dos recursos interpostos pelos utentes cuja inscrição para emprego foi anulada por incumprimento destes deveres. Esta comissão, independente e fora da linha hierárquica do Instituto do Emprego e Formação Profissional (IEFP), veio reforçar as garantias dos desempregados no que respeita à análise e decisão sobre os recursos interpostos, contribuindo ainda para uma uniformização de critérios nas várias regiões e serviços locais do país. A génese da Comissão, a sua constituição e práticas durante os sete anos completos de atividade são o objeto deste trabalho, que assenta metodologicamente na análise das fontes legais, dos relatórios de atividade do IEFP e da Comissão de Recursos, em entrevistas com atores do processo negocial que deu origem à Comissão e em entrevistas com atores locais, além de contactos com representantes de serviços de emprego de outros países europeus. As conclusões apontam para a singularidade da figura na administração pública portuguesa e para a sua originalidade no quadro dos sistemas públicos de emprego europeu que conhecemos. A sua independência permite o distanciamento da análise, com vantagem para os cidadãos e para os próprios serviços de emprego, que reconhecem o mérito da figura, não só quanto às decisões tomadas, como também quanto à função pedagógica que também desempenha. Foi também sublinhada a vantagem da proximidade dos Vice-coordenadores regionais à realidade local. Os dados obtidos revelam, apesar de tudo, uma baixa taxa de recurso à Comissão, que pode significar alguma descrença dos cidadãos nos mecanismos graciosos de decisão que lhes são postos à disposição. De sublinhar também que do que é conhecido, todas as decisões escrutinadas judicialmente após intervenção da Comissão de Recursos são convergentes com a sua decisão / deliberação, o que aponta para a correção jurídica das análises feitas nesta sede. No que respeita a perspetivas de futuro, resulta da investigação que deveria ser estudado o alargamento do âmbito de atuação da Comissão, aos desempregados não subsidiados e eventualmente também aos beneficiários do Rendimento Social de Inserção, cujo respetivo plano de inserção passe por integração em medidas promovidas pelo IEFP. Por outro lado, este modelo, com as necessárias adaptações, poderia ser replicado em outros organismos da Administração Pública, criando uma nova relação entre o cidadão e o Estado.

This academic paper aims at studying the Appeals Board, created by the legal framework of the unemployment benefit protection, which was approved in November of 2006 and came into force in the beginning of 2007. Corresponding to a greater demand on the fulfilment of duties by the unemployed jobseekers receiving allowance, the legislator created a framework of analysis of the appeals submitted by users, whose registration as jobseekers was cancelled due to the breach of these duties. This board, independent and outside the hierarchical structure of the public employment services, strengthened the guarantees of the unemployed people with regard to examining and deciding on appeals. It also helped to unify the criteria in the various regions and local employment services. The genesis of the Board, its constitution and practices during the seven full years of activity are the object of this work, which is methodologically based on the analysis of legal sources, the Portuguese public employment services (IEFP) and the Appeals Board activity reports, on interviews with actors of the negotiating process that established the Board and on interviews with local actors as well as contacts with representatives of employment services from other European countries. The findings point to the uniqueness of this figure in the Portuguese public administration and its originality with regard to the European public employment systems we know. Its independence enables a distance from the analysis, to the advantage of citizens and of the employment services themselves that recognize the merits of this figure not only in what concerns the decisions made, but also as regards the educational function it also plays. It was also underlined the advantage of the proximity of the regional vice coordinators to the local reality. Despite this, the data collected reveal a low rate of appeals to the Board, which may indicate some disbelief on the citizens part of the efficiency of the administrative complaint mechanisms that are made available to them. It is also important to point out that, as far as we know, all the decisions scrutinized before a court after the intervention of the Appeals Board are in agreement with the decision/resolution previously made, which suggests a legal accuracy of the analysis made by the Board. With regard to future prospects, our research shows that the extension of the scope of action of the Board should be considered as to include unemployed jobseekers not receiving unemployment benefit and, if appropriate, social insertion income beneficiaries, when their integration plans compel them to be integrated in employment measures promoted by the Portuguese public employment services. On the other hand, this model, with the necessary adaptations, could be replicated in other public administration bodies, creating a new relationship between the citizen and the state.
