Políticas públicas no sector das águas e dos resíduos

Abstract

A reorganização do sector do abastecimento de água, saneamento de águas residuais e gestão de resíduos urbanos tem constituído matéria de relevo no âmbito daqueles que constituem os desafios a que o XIX Governo Constitucional se propõe, tendo como objetivos a resolução de problemas de ordem ambiental ditos de primeira geração e, ainda, problemas vigentes de sustentabilidade económico-financeira associados a este sector. Tais desígnios, que se harmonizam com mudanças estratégicas substanciais nas políticas vigentes, consubstanciam-se por alterações de ordem legislativa de suma relevância. Refira-se, em concreto, a alteração dos Estatutos da Entidade Reguladora dos Serviços de Águas e Resíduos (ERSAR) e a alteração da Lei de Delimitação de Sectores, e, também, a revisão dos regimes jurídicos dos Serviços de Âmbito Municipal e Multimunicipal de Abastecimento de Água, Saneamento de Águas Residuais e Gestão de Resíduos Urbanos. Tendo em vista este novo panorama, pretende-se efetuar uma avaliação sobre a exata medida das políticas que se auspiciam prosseguir, suas implicações ao nível da regulação do sector e sua relação com a autonomia do poder local, proferindo-se, também, considerações no que diz respeito às repercussões nas atividades de gestão ao nível dos sistemas municipais e da sua relação com as partes interessadas, designadamente com os utilizadores. Pretende-se, ainda, analisar o processo em curso de produção e implementação de políticas públicas e sua conciliação com aquelas que constituem as tendências internacionais, designadamente no contexto do sector em estudo.

The reorganization of the water supply, wastewater sanitation and municipal waste sector has been an issue of relevant importance in the context of those which constitute the challenges proposed by the XIX Constitutional Government, having as objective the resolution of first generation environmental problems and remaining sustainability and financial problems within this sector. Such reorganization, which harmonizes with substantial strategic changes in current policies, is being implemented by legislative changes of enormous relevance. It should be noted, in particular, the amendment to the Statutes of the Regulatory Entity of Services for Water, Wastewater and Solid Waste Management (ERSAR) and the amendment of the Law of Delimitation of Sectors, and, also, the revision of the legal framework of Multimunicipal and Municipal Services of Water Supply, Wastewater Sanitation and Urban Waste Management. In view of this new scenery, this master thesis intends to carry out an assessment on the exact objectives of these new policies, its implications in what concerns regulation of the sector and its relation with the autonomy of local power, and, also, has aim to submit some considerations regarding the effects on management activities at the level of municipal systems and their relationship with the interested parties, in particular with the users. It also attempts to analyze the ongoing process of production and implementation of public policies and its adequacy with international current trends, particularly in the context of the sector under study.
