Abstract: | A falta de competitividade a nível fiscal e a necessidade de assegurar e atrair investimento estrangeiro levou o Governo português a levar a cabo uma reforma do IRC, concretizada através do Lei n.º 2/2014, de 16 de janeiro, a qual introduziu várias alterações ao Código do Imposto sobre o Rendimento das Pessoas Coletivas, nomeadamente ao nível da eliminação da dupla tributação. Neste domínio, tanto a nível nacional como internacional foi criado o regime de participation exemption. Este regime prevê que os lucros e reservas distribuídos de participações qualificadas e as mais-valias não concorram para a determinação do lucro tributável dos sujeitos passivos residentes em Portugal. Numa primeira parte do trabalho explicamos este novo regime em Portugal e comparamo-lo com o de outros países da Europa (Holanda, Itália, Noruega e Reino Unido), onde este já se encontrava implementado. Posteriormente realizámos entrevistas a docentes na área da Fiscalidade, contabilistas certificados, revisores oficiais de contas, representantes das finanças, e representante da Ordem dos Contabilistas Certificados, para percebermos a sua opinião quanto a este regime e se será realmente vantajoso para as empresas portuguesas.
Concluímos que o regime de participation exemption se tornou efetivamente tão competitivo como o holandês. Porém, os seus resultados apenas serão visíveis no longo prazo pois não é esperado um regresso imediato de empresas para Portugal e, consequentemente, também não haverá aumento da receita, especificamente dos outros impostos (IRS, Segurança Social, IVA). The lack of competitiveness the tax level and the need to ensure and attract foreign investment took the Portuguese Government to carry out a reform of the CIT, implemented by Law No. 2/2014 of 16 January, which introduced several changes to the Tax Code on Corporative Income, particularly in terms of elimination of double taxation. In this field, both nationally and internationally, was created the participation exemption regime. This scheme provides that profits and reserves distributed in qualifying holdings and capital gains do not compete for determining the taxable income of resident taxpayers in Portugal. In the first part of the project we explain this new regime in Portugal and compared it with other European countries (Netherlands, Italy, Norway and the United Kingdom), where it was already implemented. Later we conducted interviews with teachers in the area of taxation, certified accountants, auditors, representatives of finance, and representative of the Order of Certified Accountants, to realize their opinion on this regime and whether it will be really beneficial for Portuguese companies. We conclude that the participation exemption regime has effectively become as competitive as the Dutch. However, the results only will be visible in the long run. It is not expected the immediate return of companies to Portugal and consequently there will be no increase in revenue, specifically other taxes (PIT, Social Security, VAT). |
