Enquadramento de legislação nos Sistemas de Segurança Social

Abstract

A Segurança Social é um direito constitucional. Para os cidadãos se poderem valer desse direito têm que conhecer a lei que o tutela. Contudo, não é uma tarefa fácil, uma vez que a legislação da segurança social se encontra dispersa por leis com quase trinta anos de vigência. Este trabalho propõe uma organização das leis de segurança social pelos Sistemas da Segurança Social que constam da Lei de Bases da Segurança Social – Lei N.º 4/2007 de 16/01, actualmente em vigor. Assim a legislação da segurança social será enquadrada nos três sistemas da Segurança Social: Sistema de Protecção Social e de Cidadania, Sistema Previdencial e Sistema Complementar. Serão também mencionados os deveres que os cidadãos têm para poderem usufruir desse direito constitucional

Social security is a constitutional right. For the citizens benefit of that right thy need to know the law. However, it is not an easy task, since the social security legislation is dispersed by laws with almost thirty years of life This paper proposes to organize the social security laws by the social security systems mentioned on the Law on Social Security - Law No. 4 / 2007 of 16/01, currently in use. So the social security legislation will be framed in the three systems of Social Security: System of Social Protection and Citizenship, welfare system and complementary system Will also be referred the obligations of citizens to make use of this constitutional right.
