Julgados de paz e mediação: uma nova face da justiça

Abstract

O presente trabalho propóe-se avaliar o funcionamento dos Julgados de Paz em Portugal, enquanto nova proposta de administração da justiça, de cariz desjudicializado, bem como a mediação, na vertente de meio alternativo de resolução de litigios, integrada nos Julgados de Paz. Esta tese está organizada em três capítulos. O Capitulo I, denominado: A Crise da Justiça no Século XXI, tem em vista proceder ao enquadramento do tema, contextualizando a situação da justiça aquando da emergência dos Julgados de Paz em Portugal, no ano 2002; O Capitulo II, denominado: Os Julgados de Paz, incide directamente sobre a temática em apreço, nos moldes actualmente existentes e o Capitulo III, denominado: O Futuro dos Julgados de Paz, visa apresentar propostas de melhoria dos Julgados de Paz, tendo por base o seu objectivo inicial e os propósitos da sua criação. De salientar o inquérito levado a cabo, junto dos utentes de diversos Julgados de Paz, e os dados estatísticos disponíveis sobre o respectivo movimento processual, cujas conclusóes contribuíram para a avaliação do projecto.

It is the purpose of the present work to evaluate the functioning of the Peace Courts in Portugal, while being a new proposal on the adrninistration of justice, based on an extra-judicial basis, as well as to evaluate the practise of rnediation as an alternative dispute resolution means, enclosed within the jurisdiction of the Peace Courts. This thesis comprises three rnain chapters: Chapter I "Justice Crisis in the XXI century" has, as an object, the framing of the theme within the context of the Justice systern since the Peace Courts carne into being in Portugal, in the year 2002; Chapter II, under the heading of "The Peace Courts", focuses directly on the subject as well as the actual basis on which they rest, and Chapter III, under the title of "The future of the Peace courts", presents some new proposals on the improvement of the Peace Courts, based on their initial objective and on the purposes of their irnplernentation. Attention is called to the conclusions that derived from both the inquiry made next to the real users of severa1 existing Peace Courts and to the statistical data available on the cases flow, which have greatly contributed to achieve a better evaluation of this project.
