As comunidades e territórios tradicionais nas estratégias de adaptação às alterações climáticas: do direito ao plano

Abstract

As comunidades tradicionais são altamente vulneráveis aos impactos das alterações climáticas, dada a conexão com a natureza e seu território. Esta tese assenta-se no argumento de que o maior envolvimento das comunidades tradicionais nas políticas climáticas e ambientais pode proteger o modo de vida tradicional, além de viabilizar a criação de planos de adaptação e mitigação mais compatíveis com os diferentes contextos. Entretanto, ainda não está claro qual o papel desempenhado pela legislação, planos e programas climáticos na proteção de comunidades e territórios tradicionais. Esta investigação teve por objetivo, usando Brasil e Portugal como contextos de estudos, avaliar (i) se os instrumentos político-normativos relacionados às alterações climáticas incorporam os direitos de proteção e participação das comunidades e territórios tradicionais, (ii) o grau de coerência entre os objetivos e metas dos instrumentos nos diferentes níveis de decisão e (iii) as percepções das comunidades tradicionais sobre a concretização dos seus direitos nestes instrumentos. A metodologia de investigação está organizada em duas vertentes, a primeira estuda a concretização dos direitos das comunidades tradicionais através da análise de conteúdo de instrumentos político-normativos, e a segunda identifica, através de entrevistas semiestruturadas, as percepções de comunidades tradicionais sobre a salvaguarda de seus direitos. Os resultados mostram, em termos gerais, que as recomendações relacionadas às comunidades e territórios tradicionais são recentes na política climática internacional e que sua transposição para os instrumentos de nível nacional e municipal ainda é limitada, sobretudo na componente participação, o que evidencia um baixo grau de coerência entre os diferentes níveis de governação. Os resultados também mostram uma limitada atenção aos conhecimentos tradicionais e seus contributos para ações de mitigação e adaptação. A análise das percepções das comunidades tradicionais mostrou que elas desconhecem a existência de instrumentos direcionados a salvaguardar seus direitos frente aos impactos adversos das alterações climáticas, sobretudo em âmbito nacional e municipal, e que não se sentem protegidas. As principais conclusões da tese revelam que os aspectos de proteção e participação das comunidades e territórios tradicionais devem ser fortalecidos nos diferentes níveis de decisão. Para tanto, o desenho de instrumentos político-normativos relevantes para a adaptação e mitigação às alterações climáticas deve ser mais sensível e robusto diante dos contributos dos conhecimentos tradicionais, a partir do diálogo de saberes. Assim, o estudo vem salientar que há ainda um caminho a percorrer para uma concreta tradução dos tratados internacionais nos instrumentos nacionais e municipais e sua comunicação às comunidades tradicionais.

Traditional communities are highly vulnerable to climate change impacts due to the link between the environment and their territories. This thesis argues that the extensive involvement of communities in the climate and environmental policies could protect traditional lifeways and contribute to creating mitigation and adaptation plans more suitable with different contexts. However, the role of climate legislation, plans, and programs to protect traditional communities and territories is still unclear. Based on Brazil and Portugal cases, this study has three goals: i) to evaluate whether climate-related normative-policy instruments consider the protection and participation right of the communities, ii) to analyze the coherence level of the instruments, in terms of objectives and purposes, under different decision levels, and (ii) to investigate the perception of the communities about the achievement of their right in the instruments. The methodology of the study is structured in two approaches. The first one analyses the concretization of the communities' rights in the climate-related normative-policy instruments using content analysis. The second approach identifies how the communities perceive the preservation of rights based on semi-structured interviews. Overall, the results show the recommendation related to the traditional communities and territories are recent in the international climate policy, and the translation of the guidelines to the instruments at the national and municipal level is still limited, especially the participation component, which evidences the low coherence level among different governance stages. Furthermore, the study demonstrates limited attention to traditional knowledge and its contributes to mitigation and adaptation actions. The analysis of the traditional communities' perceptions showed that they are unaware of instruments aimed at safeguarding their rights against the adverse impacts of climate change, especially at the national and municipal levels, and that they do not feel protected. The main conclusions reveal that the aspects of protection and participation of traditional communities and territories must be strengthened at the different levels of decision-making. Therefore, the design of relevant political-normative instruments for climate change adaptation and mitigation must be more sensitive and, above all, more robust in the face of traditional knowledge's contributions, based on the dialogue of knowledge. Thus, this thesis highlights that there is still a way ahead for a concrete translation of the international law to national and municipal instruments and the communication to the traditional communities.
