Alterações a planos urbanísticos : Portugal e Inglaterra

Abstract

A cidade, como construção colectiva, desenvolveu-se no território através de vários processos ao longo da história. O Homem no seu propósito civilizacional utilizou o planeamento urbanístico como processo privilegiado para a ordenar. Neste processo o plano urbanístico é, em síntese, o instrumento com o propósito de regular as operações urbanísticas subsequentes no território que abrange. Quaisquer que sejam os objectivos a que se propõe, o plano não é um fim em si mesmo, dado que existem diversas motivações e interesses que durante a sua execução o vão questionando. Essas ocorrências potenciam a sua alteração, pelo que este é um dado a ter em conta em todo o processo de planeamento. Acresce que a transformação da sociedade actual é cada vez mais dinâmica e diversificada, e o seu processo de desenvolvimento tem consequências proporcionais e recíprocas nas interacções com o planeamento urbanístico, através dos diversos agentes, meios e métodos que intervêm na cidade. Por outro lado a sociedade rege-se (cada vez mais) pelas regras do mercado, onde o lucro apresenta uma primazia em todo o processo e, em matéria de urbanismo, pretende intervir sobre um bem escasso – o solo – cujo valor de mercado depende, entre outros factores, de todo este processo. Os interesses em jogo são múltiplos e por vezes contraditórios entre os diversos agentes intervenientes. Compete à Administração Pública liderar o processo e zelar para que os interesses privados não se sobreponham ao interesse público, que deve representar. Em síntese, pretendem-se estabelecer critérios de avaliação das ocorrências consideradas desejáveis ou aceitáveis, que justifiquem a alteração do plano urbanístico durante a sua execução, sem esquecer as variações do valor de mercado daí decorrentes e ensaiar critérios de decisão para que possam ser aceites por parte da Administração.

ABSTRACT: The city, as collective construction, was developed in the territory through some processes throughout history. The Man in its civilizational intention used the urban planning as privileged process to command. In this process the urban plan is, in synthesis, the instrument with the intention of regulating the subsequent urban operations in the territory that it encloses. Any that are the objectives the one that if consider, the plan is not an end in itself exactly, data that exists diverse motivations and interests that during its execution go questioning. These occurrences harness its alteration, for what this is data to have all in account in the planning process. It increases that the transformation of the current society is each more dynamic and diversified time, and its process of development has proportional and reciprocal consequences in the interactions with the urban planning, through the diverse agents, ways and methods that intervene in the city. On the other hand the society is conducted (each time more) for the rules of the market, where the profit all presents a priority in the process and, in urbanism substance, it intends to intervene on a scarce good - the ground - whose value of market depends, among others factors, of all this process. The interests in game are multiple and for contradictory times between the diverse intervening agents. It competes to the Public Administration leading the process and watching over so that the private interests are not overlapped to the public interest, that must represent. In synthesis, they intend to establish criteria of evaluation of the desirable or acceptable considered occurrences, that justify the alteration of the urban plan during its execution, without forgetting the variations it from there decurrent value of market and to assay decision criteria so that they can be acceptances on the part of the Administration.
