A globalização e a justiça internacional

Abstract

O presente trabalho tem como objectivo suscitar a questão dos efeitos da globalização na área da Justiça Internacional. Assim, este estudo começa por abordar o conceito da globalização, a sua história e os seus efeitos, para em seguida analisar duas das áreas no âmbito da justiça internacional que melhor espelham a influência da globalização: os direitos humanos, e os tribunais internacionais. No que se refere aos direitos humanos, estuda-se a sua evolução e adaptação à globalização. Quanto aos tribunais internacionais, pretende-se oferecer um panorama geral dos mesmos, conferindo um especial relevo ao Tribunal Penal Internacional e ao Tribunal Europeu dos Direitos do Homem. Finalmente, são apresentadas as conclusões da análise feita ao longo do trabalho.

ABSTRACT: The present work has the goal of triggering a discussion about the effects of globalisation in the field of International Justice. Hence, this work starts with an overview of the concept of globalisation, its history and general effects. This is followed by an analysis of two fields within the scope of international justice that best reflect the influence of globalisation in this context: human rights and international courts of law. In the case of human rights, it’s focused on its evolution and adaptation to globalisation. As for international courts of law, the purpose is to offer an overview of the existing system, with special attention to the International Criminal Court and the European Human Rights Court. The final section is dedicated to the conclusions drawn from the analysis done along the work.
