No reino da incerteza: a implementação do Lay-Off simplificado na Segurança Social de Aveiro

Abstract

O primeiro caso de Covid-19 foi reportado em 31 de dezembro de 2019, na República Popular da China, na cidade de Wuhan, e, em 11 de março de 2020, a Organização Mundial da Saúde declarou o surto como uma pandemia. Devido a esta pandemia, num curto espaço de tempo, o mundo e o país isolaram-se e as empresas fecharam as portas. Face à evolução grave da doença, e ao desconhecimento das suas reais consequências, pela primeira vez em democracia, em todo o território nacional, foi declarado o estado de emergência, com a inerente suspensão do exercício de direitos prevista no artigo 19.º da lei fundamental, a Constituição da República Portuguesa. A pandemia trouxe mudanças inesperadas, e consequências ainda não conhecidas, à sociedade no seu todo. Devastou a economia, devido, sobretudo, ao isolamento obrigatório e a uma brusca diminuição do consumo. Neste contexto, em Portugal, foram implementadas, pelo Governo Central, várias medidas de mitigação da crise, ao nível socioeconómico. Uma delas foi o Lay-Off Simplificado, que foi instituído para evitar a falência das empresas e o despedimento de trabalhadores. Deste modo, no sentido de averiguar até que ponto o Lay-Off Simplificado surtiu, ou não, os efeitos pretendidos, a presente investigação, cingida às empresas do concelho de Aveiro, e assente numa metodologia mista, pretende estudar todo o processo da sua implementação, nomeadamente, a articulação entre os agentes da Segurança Social e o tecido económico, e analisar se, de facto, tal medida permitiu, ou não, àquelas empresas fazer face à crise económica originada pela pandemia. Do estudo, resultam algumas conclusões. Fundamentalmente, a de que, não obstante alguns impedimentos e ajustes, que tiveram de ser feitos ao longo do processo de implementação, e foram aqui também analisados, o Lay-Off Simplificado, assentando numa tramitação processual não complexa, no que se refere às empresas do concelho de Aveiro, revelou-se, no seu todo, eficaz, tendo cumprido os seus principais objetivos de base: evitar despedimentos e o consequente desemprego. No entanto, concluiu-se também que a reflexão e a proação sobre a problemática do emprego futuro não devem nunca ser descuradas e, por isso, propõem-se, aqui, também algumas reflexões nesse sentido.

The first reported case of Covid-19 occurred on December 31, 2019, in China, a t the city of Wuhan, and, on March 11, 2020, the World Health Organization declared that the outbreak, as a matter of fact, was a pandemic. Due to this, in a very short period of time, the world and the country became isolated and companies closed their doors. As a consequence of the dangerous quick evolution of the disease, and the lack of knowledge of its real effects, for the first time in a democracy, throughout the national territory, a state of emergency was declared, with the inherent suspension of the exercise of the citizen rights, supported by the article 19 of Portugal´s fundamental law: the Constitution of the Portuguese Republic. The pandemic brought unexpected changes, and as yet unknown consequences, to Portuguese society as a whole. It devastated the economy, mainly due to mandatory isolation and a sharp drop in consumption. In this context, the Portuguese Central Government implemented several measures to mitigate the crisis, at the socio-economic level. One of them was the Simplified Lay-Off, which was instituted to avoid the bankruptcy of companies and the dismissal of workers. Thus, in order to find out to what extent the Simplified Lay-Off had, or not, achieved its intended positive effects, based on a mixed methodology, this research analyses the companies in the municipality of Aveiro, and aims to study the entire process of its implementation; namely, the articulation between the agents of Social Security and the economic fabric and wants to find out if this measure, in fact, allowed, or not, those Aveiro´s companies to face the economic crisis caused by the pandemic. From this research some conclusions have emerged. Fundamentally, that, despite some impediments and adjustments, which had to be made during the whole process and were also analyzed here, the Simplified Lay-Off, based on a non-complex procedural process, with regard to companies in the municipality of Aveiro, was, overall, effective, having fulfilled its main objectives: to avoid redundancies and the consequent unemployment. Nevertheless, it was also concluded that reflection and pro-action on the issue of future employment must not be neglected and therefore some analytical thought on this matter was also added.
