Abstract: | Nenhuma sanção criminal deve implicar como consequência a perda de
direitos civis, profissionais ou políticos. O ideário de reinserção de delinquentes
tem suscitado alguma controvérsia relativamente à sua efetiva aplicação.
O sistema prisional tem como prepósito punir o indivíduo, mas sobretudo
(re)educá-lo, trabalhando na construção de comportamentos alternativos a
trajetórias desviantes. Neste sentido, a presente investigação pretendeu
entender em que medida os reclusos são apoiados ainda no contexto de
reclusão, tendo em vista a posterior reinserção social. Um dos focos do
presente trabalho prende-se com a análise dos planos existentes de apoio a
estes indivíduos, desde que entram nos estabelecimentos prisionais, até ao
momento de saída (quando devolvidos à sociedade). Contudo, existem um
conjunto de variáveis que influenciam a efetividade destes planos, tais como a
tipologia de crime, a duração da pena, o grupo etário, o grau de gestão, entre
outras, que são determinantes para a abrangência e aplicação destes planos.
Deste modo, tornou-se relevante fazer uma análise estatística das populações
reclusas. O contexto de reclusão, em muitos casos, acaba por ser decisivo na
deterioração da identidade do indivíduo infrator, vinculando-o a um
estigma/rótulo. Assim, é importante construir uma intervenção a partir de vários
processos, com vista à reinserção social dos ex-reclusos, evitando que estes
indivíduos enveredem novamente por comportamentos criminais No criminal penalty should entail the loss of civil rights, be they professional or political, as a consequence. The reinsertion ideology of delinquents has aroused some controversy regarding its effective implementation. The prison system has the function of punishing the individual, but, above all, of (re)educating them, working on the construction of alternative behaviors to devious trajectories. For that reason, this investigation was meant to understand in what ways convicts are supported, while serving their sentence, in order for them to be socially reinserted, later on. One of the focal points of this effort lies on the analysis of existing support plans for these individuals, from their entrance in prison facilities, to the moment of their release (when they’re returned to society). There is, however, a set of variables that influence the effectiveness of such plans, like the kind of crime, sentence duration, age group, degree of management, among others, which are vital for the comprehensiveness and implementation of these plans. As such, it has become relevant to do a statistic analysis of convict populations. The context of conviction ends up being decisive in the deterioration of the offender’s identity, in many cases, binding them to a stigma/label. Thus, it’s important to construct an intervention made up of various processes with the purpose of socially reinserting ex-convicts, preventing them from exhibiting criminal behaviors once again. |
