Uma experiência no âmbito da avaliação de impacto legislativo em Portugal

Abstract

A elaboração deste Relatório de Estágio insere-se no âmbito do estágio curricular do Mestrado em Economia da Universidade de Aveiro, com início a 23 de fevereiro e término a 24 de agosto de 2017. Tem como objetivo apresentar o trabalho desenvolvido no Núcleo de Avaliação de Impacto Legislativo, criado para a implementação de uma medida pública, o “Custa Quanto?”. Neste contexto, procura-se expor e explorar a metodologia de Avaliação Prévia de Impacto Legislativo implementada no período experimental, à luz de padrões e práticas internacionais. Abre-se um novo espaço para a potenciar a Governança Regulatória em Portugal, através do desenvolvimento de uma ferramenta amplamente difundida no platô internacional, a Avaliação de Impacto Regulatório (AIR), cuja efetiva aplicação trará novos inputs para o debate, dentro e fora da ação governativa, melhorando e inovando os tradicionais métodos de apoio aos decisores políticos. É de esperar que a atividade desenvolvida por este núcleo, em conjunto com os vários agentes governamentais, contribua para aumentar a eficiência e eficácia do procedimento legislativo com origem no Governo, elencando os impactos socais, económicos ou ambientais que derivam de tais atos normativos. Para tal, realiza-se uma análise de contexto do estágio, partindo da caracterização da entidade de acolhimento para a descrição das atividades desenvolvidas, apresentando-se um enquadramento teórico sobre a AIR no plano internacional, suas perspetivas e tendências, bem como em Portugal, e, por fim, casos práticos que seguem a metodologia portuguesa adotada no projeto-piloto, de forma a elucidar sobre a forma como se procede à estimação dos encargos decorrentes da legislação.

The preparation of this Internship Report falls within the scope of the curricular internship of the Master’s degree in Economics of the University of Aveiro, beginning on February 23 and ending on August 24, 2017. Its objective is to present the work developed in the Evaluation Center of Legislative Impact, which arose from the need to implement a public measure carried out by the measure "Costing - Making Accounts to the Law", seeking to expose and to explore the methodology of Previous Assessment of the Legislative Impact implemented in the experimental period, in the light of standards and practices countries. A new space is opening up to foster Regulatory Governance in Portugal through the development of a widely diffused tool in the international plateau, the Regulatory Impact Assessment, whose effective application will bring new inputs to the debate, inside and outside the government action, improving and innovating traditional methods of support for policy makers. It is to be hoped that the activity developed by this Nucleus, together with the various governmental agents, will contribute to increase the efficiency and effectiveness of the legislative procedure originated in the Government, listing the social, economic or environmental impacts that derive from such normative acts. To do this, a context analysis of the stage is carried out, starting from the characterization of the host organization for the description of the activities developed, presenting a theoretical framework on AIR at the international level, its perspectives and trends, as well as in Portugal, and, finally, practical cases that follow the Portuguese methodology adopted in the pilot project, in order to elucidate about the estimation of the costs deriving from the legislation.
