Abstract: | Em setembro de 2013 foi publicada em Diário da República a décima terceira
alteração ao Código da Estrada Português. Uma das principais alterações
introduzidas por esse diploma legal está ligada à circulação de velocípedes na
via pública. Nesta dissertação pretendeu-se levar a cabo uma discussão sobre
essas alterações e analisar o seu impacto no modo ciclável, com especial
enfoque na infraestrutura a ele dedicada.
Foi analisada a evolução dos Códigos da Estrada Portugueses até à
atualidade e efetuou-se uma análise comparativa com Códigos da Estrada em
vigor noutros países, designadamente, Holanda e Reino Unido, sempre na
perspetiva da bicicleta.
Foi realizado um inquérito sobre as novas alterações relativas aos
velocípedes, de forma a avaliar a perceção e conhecimento dos portugueses
relativamente às mesmas e foi ainda analisada a sinistralidade nas estradas de
Portugal (continente), antes, durante e após a implementação dessa mesma
legislação.
Foi também estudado de que forma estas novas regras podem favorecer a
conceção de uma infraestrutura mais adequada à utilização do modo ciclável,
apresentando propostas e soluções legislativas a esse nível.
Finalmente, concluiu-se que, cerca de um terço dos inquiridos que utilizam
as estradas portuguesas, seja como peões, utilizadores de velocípedes ou
condutores de veículos motorizados, não conhecem as novas leis relativas à
utilização de velocípedes introduzidas no Código da Estrada Português em
2013. Quando questionadas as pessoas que conhecem o novo Código da
Estrada sobre os benefícios das novas regras, nem sempre se gerou o
consenso, havendo mesmo propostas de melhoria tanto da legislação como da
infraestrutura. Relativamente ao impacto na infraestrutura ciclável, aprofundouse
que espécie de melhoramentos da via e da sinalização devem ser
efetuados, de modo a que as novas regras possam ser postas em prática de
uma forma segura e confortável a todos os utilizadores das vias públicas. In September 2013, the thirteenth modification to the Portuguese Official Road Code was published in the Official Journal (Diário da República). One of the main modifications introduced by this decree is connected to the circulation of cycles in public roads. In this dissertation we intend to carry out a discussion about these alterations and analyse their impact on the cycling mode with greater emphasis in the infrastructure dedicated to it. The evolution of the Portuguese Official Highway Code was studied up to the present date and a comparative analysis between the Portuguese, the United Kingdom and the Netherland’s road codes was carried out, having the bicycle perspective permanently in mind. A survey about the new cycle code modifications was carried out to assess the perception and knowledge of the Portuguese about the alterations; road accidents and deaths were also studied within Continental Portugal before, during and after the implementation of this legislation. The ways in which these new rules may favor the conception of a more adequate infrastructure to the cycling mode was looked into as well, drawing up proposals and legislative solutions. Finally, it was concluded that about one third of the survey respondents who use the Portuguese roads, as pedestrians, cyclists or drivers of motorised vehicles are not acquainted with the new 2013 road code regulations concerning the use of cycles. Despite the laws being in place, within those who were familiar with the new road code, when questioned about the benefits of these new rules, not all were in agreement and there were even some improvement proposals. In relation to the impact in the cycling infrastructure, it has deepened what kind of improvements on the road and signage must be performed, so that the new rules can be put into practice in a safe and comfortable way by all the public road users. |
