Linhas de Evolução da Lei Penal da República Popular da China: Uma Abordagem Histórico-Política

Abstract

Com este trabalho procura dar-se uma visão da evolução do direito penal revolucionário chinês, desde a aliança PCC/GMD até à actualidade da R.P. da China. A exposição sobre essa evolução é enquadrada na evolução histórica e política pelo que, em boa parte, a história do direito é também a história da evolução da guerra civil chinesa e do percurso da República Popular. A primeira parte tem natureza fundamentalmente introdutória, abrangendo todo o período que antecedeu a fundação da RPC. A partir daí a exposição reparte-se por capítulos, relativos a períodos com especial significado para o tema do trabalho: anti-campanhas dos anos 50; primeira constituição e primeiras leis penais; campanha anti-direitista e período subsequente até à Revolução Cultural; Revolução Cultural e Constituição de 1975; Período pós-Mao e Constituição de 1978; Código Penal de 1979; Constituição de 1982 e posterior produção legislativa e Revisão do código penal de 1997. Cremos tratar-se de um trabalho que preenche uma lacuna existente nos estudos chineses, pelo menos em Portugal.

This work is an overview of the evolution of the Chinese revolutionary penal law, from the alliance CCP/GMD to the present of Popular Republic of China. The presentation about that evolution is framed in the historical and political evolution because, in good part, the history of the law is also the history of the evolution of the Chinese civil war and of the course of New China. The first part has mainly introductory nature, embracing the whole period that preceded the foundation of PRC. Starting from there the presentation is distributed by chapters, relative to periods with special meaning for the theme of the work: anti-campaigns of the fifties; first constitution and first penal laws; anti-rightist campaign and subsequent period to the Cultural Revolution; Cultural Revolution and Constitution of 1975; Pos-Mao period and Constitution of 1978; Penal Code of 1979; Constitution of 1982 and later legislative production and Revision of the Penal Code of 1997. We believe this work fills a gap in Chinese studies, at least in Portugal.
