Contratos de trabalho e tradução jurídica (Português-Espanhol)

Abstract

O presente projeto consiste no estudo e tradução de textos jurídicos de contratos de trabalho de duração temporária, hoje vigentes em Portugal e Espanha. As relações laborais entre estes dois países são muitas devido à sua proximidade. Por outro lado, os contratos de trabalho de duração temporária são um dos tipos de contratação mais utilizados atualmente, sendo um dos fatores que levam à precarização do mercado de trabalho. Neste estudo, apresentaremos as Fontes de Direito do Trabalho dos dois países, de maneira a entender os seus ordenamentos jurídicos e poder situar o contrato de trabalho entre estas fontes. Posteriormente, analisaremos as principais características textuais destes documentos para que seja possível entender as suas particularidades; relacionaremos a precariedade laboral com os contratos de trabalho e apontaremos noções jurídicas básicas sobre estes mesmos contratos. Por fim, apresentamos documentos representativos da realidade laboral destes dois países e procedemos à tradução dos mesmos, sendo que as principais dificuldades que encontramos ao longo da tradução serão analisadas e comentadas. Uma vez que o contrato de trabalho é um documento presente no dia-a-dia de um grande número de pessoas, este projeto pretende dar conta das principais dificuldades na hora de traduzi-los nas duas línguas — português e espanhol. Destacaremos as diferenças entre os contratos dos dois países, para que sirvam de ferramenta facilitadora a futuros tradutores deste âmbito jurídico e laboral.

The present work consists of the study and legal translation of employment contracts texts, from Portugal and Spain. Labour relations between these two countries are common because of their proximity. On the other hand, temporary employment contracts are one of the most used types of employment nowadays, which leads to the increase of job insecurity on the labour market. In this study, we will present the Sources of Labour Law of both countries in order to understand their legal systems and place the employment contract between these sources. Afterwards, we will analyse the main textual characteristics of these documents in order to understand their particularities; we will relate job insecurity with employment contracts and we will point out basic legal notions about these contracts. Finally, we will present real documents that represent the labour situation in these two countries and we will translate them, commenting on the main difficulties that we found during translation. Since the employment contract is a document that is present in the daily life of a large number of people, this project aims to point out the main difficulties during their translation on these two languages – Portuguese and Spanish. We will also highlight the differences between the contracts of these two countries, aiming to create a facilitating tool for future translators of these legal and labour specialised area.
