O processo de elaboração da lei de bases da educação de Timor-Leste: entre a regulação nacional e a regulação transnacional

Abstract

A partir de 2008, o sistema educativo timorense passou a orientar-se pela Lei de Bases da Educação [LBE], Lei n.º 14/2008 de 29 de Outubro, que representa o primeiro enquadramento legal genérico decretado para a área da educação no Estado Independente de Timor-Leste. A LBE fundamenta as diretrizes bases de referência para a organização, orientação, regulação e desenvolvimento do sistema educativo timorense. O presente estudo visa descrever, analisar e compreender o processo da elaboração da Lei de Bases da Educação [LBE] de Timor-Leste. A metodologia utilizada enquadra-se no estudo qualitativo, recorrendo à análise documental e a entrevistas semiestruturadas, realizadas aos quatros informadores privilegiados que estiveram envolvidos diretamente no processo da elaboração até à promulgação da LBE. O tratamento da informação efetuou-se pela análise de conteúdo mediante a construção de categorias. Da pesquisa constatamos que a elaboração da LBE tem origem na necessidade emergente de estabelecer um enquadramento legal para a área da educação. Durante os primeiros cinco anos iniciais do Estado Independente de Timor-Leste essa ausência foi notória. Constatava-se ainda a necessidade crucial de estandardizar a educação nacional, melhorar a organização e o funcionamento do sistema educativo e a promoção da qualidade do ensino e aprendizagem, que é um imperativo para o desenvolvimento da educação de Timor-Leste. Com esse objetivo, estabelece-se a regulação nacional para a área da educação através da elaboração da proposta da LBE pelo Ministério da Educação, precedida pela consulta realizada no âmbito nacional e internacional, aprovada pelo governo em mandato, que era o IV Governo Constitucional (2007-2012), a qual foi posteriormente submetida ao Parlamento Nacional para discussão e aprovação. Por meio da Comissão de Saúde, Educação e Cultura [CSEC] organizou-se as audiências públicas à sociedade timorense de modo a verificar o consenso do governo e do povo. De seguida, realizou-se as sessões no plenário. Os representantes dos povos no Parlamento Nacional votaram a aprovação da proposta da LBE com maioria absoluta. De seguida, o documento da LBE aprovado foi enviado ao Presidente da República para ser promulgado e publicado no Jornal da República, antes de entrada em vigor.A promulgação da LBE fortaleceu o papel do Ministério da Educação como autoridade legítima da área da educação, para estabelecer a regulação nacional, de modo a orientar e organizar melhor o funcionamento do sistema educativo timorense em função da LBE. Uma avaliação positiva foi atribuída à elaboração da proposta da LBE pelos informadores privilegiados, embora tenham sublinhado a necessidade de produção da legislação para a sua implementação. Notou-se a aproximação da LBE timorense com a Lei de Bases do Sistema Educativo [LBSE] Português, Lei n.º 46/86 de 14 de Outubro, com destaque para o Projeto da Lei n.º 55/X sobre a Lei de Bases da Educação, ou seja, o projeto de alteração da LBSE – Lei n.º 46/86, proveniente do grupo parlamentar do Partido Social Democrata [PSD] da Assembleia da República Portuguesa apresentado à Comissão de Educação, Ciência e Cultura em 2005. Assim, observou-se a adaptação da regulação transnacional para o contexto timorense, através da seleção de modelos educativos de outros países cujos contextos e políticas educativas se identificam e sincronizam com a política educativa timorense. Tendo em conta que a LBE contempla os padrões da educação a nível internacional, temos de reconhecer que, por enquanto, o sistema educativo timorense ainda está na fase inicial da sua construção, e que, por isso, é requerida muita determinação e persistência do povo e autoridades timorenses no cumprimento dos objetivos traçados na LBE.

Since 2008, the education system of the Timorese started to be guided by the Law of Basic Education [LBE], Law No. 14/2008, 29 October, which is the first legal framework established for education in independent state of East Timor. The LBE is guidelines baselines for the organization, guidance, regulation and development of Timorese education system. The aims of this study is to analyze, describe and understand the process of drafting the Law of Foundation of Education [LBE] Timor-Leste. The methodology fits the qualitative study, using the documentary analysis and semi-structured interviews conducted with four key informants who had been involved directly in the process of drafting until the promulgation of the LBE. The management of information were made-up by the contents through the structure of categories. The research found that the elaboration of LBE is an emerging requirement for the establishment of a legal framework for the education sector. During the first five years of the Independent of East Timor, the absence of this basic law was noticeable. It was also intended to standardize national education, improve the organization and the functioning of the education system and the promotion of teaching and learning quality, which is a must for the development of East Timor education. For this purpose, establish a national regulation for the education sector through the development of the LBE proposed by the Ministry of Education, preceded by consultation in the national and international level, approved by the government in office, which was the IV Constitutional Government (2007-2012), which was subsequently submitted to the National Parliament for discussion and approval. Through the Health Committee, Education and Culture [CSEC] was organized public hearings to Timorese society in order to verify the consent of the government and the people. Then took place the sessions in plenary. The representatives of the people in the National Parliament voted to approve the proposal of the LBE with absolute majority. Next, the document approved LBE was sent to the President to be promulgated and published in the Official Gazette, before entry into force.The promulgation of the LBE strengthened the role of the Ministry of Education as the legitimate authority of the field of education, to establish the national regulation in order to guide and better organize the functioning of the Timorese education system due to the LBE. A positive evaluation was attributed to the development of the LBE proposed by the key informants, although they stressed the need for creating a decree-law to implement and accomplish the desiderata it considered. It was noted that the approach of Timorese LBE with the Basic Law of Education System [LBSE] Portuguese, Law n. º 46/86, 14 de October, especially closed to the Project of Law No. 55 / X on the Basic Law on Education, or to the project of alteration of LBSE – Lei n. º 46/86 that was proposed by a group of parliamentarians from Social Democratic Party of Portugal [PSD] submitted to the Assembly Committee on education, science and culture in 2005. Thus, there was the adaptation of transnational regulation for the Timorese context, through the selection of educational models of other countries whose contexts and educational policies identify and synchronize with the Timorese education policy. Given that the LBE comprises the standards of education internationally, we must recognize that, for now, the Timorese education system is still in the initial phase of construction, and that, therefore, it is required a lot of determination and persistence of the people and East Timorese authorities to meet the objectives outlined in the LBE.
