Denominação de origem : a região demarcada dos vinhos verdes

Abstract

O principal objectivo deste trabalho é analisar e perceber a evolução da protecção concedida à Denominação de Origem “Vinho Verde”. Face a uma pluralidade de conceitos relacionados com o nome geográfico, foi necessário distinguirmos a diversa terminologia existente, nomeadamente, indicação de proveniência, indicação geográfica e denominação de origem. Inicialmente o estudo incidiu sobre a protecção concedida à denominação de origem tanto na esfera nacional como internacional. Em relação ao regime jurídico nacional o estudo teve por base a análise do Código da Propriedade Industrial. Por sua vez, o estudo do regime jurídico internacional, debruçou-se sobre a Convenção da União de Paris para a Protecção da Propriedade Industrial, o Acordo de Madrid respeitante à Repressão das Falsas ou Falasiosas Indicações de Proveniência, o Acordo de Lisboa para a Protecção das Denominações de Origem e seu Registo Internacional e Acordo dos Direitos de Propriedade Intelectual relacionados com o Comércio. Obtendo-se, assim uma visão global da protecção concedida às denominações de origem. Numa fase posterior, o trabalho concentrou-se no estudo da legislação aplicável ao sector vitivinícola, onde foi alvo de atenção o DL nº 212/2004 que estabelece a organização institucional do sector vitivinícola, o DL nº 213/2004 que estabelece um padrão sancionatório para as infracções no sector vitivinícola, o Regulamento (CE) nº 1493/1999 que estabelece a organização comum do mercado vitivinícola e o Regulamento (CE) nº 479/2008 que veio reformar o sector vitivinícola existente. Por fim, aborda-se o Estatuto da Região Demarcada dos Vinhos Verdes que define as regras aplicáveis ao “Vinho Verde”.

ABSTRACT: The main propose of this study is to analyze and understand the evolution of the protection granted to Appellation of Origin "Vinho Verde". Faced with an overwhelming number of concepts related to the geographical name, it was necessary to distinguish the different existing terminology, in particular, indications of source, geographical indications and appellation of origin. The study initially focused on the protection granted to appellation of origin, both in the national and international sphere. On the national legal system the study was based on the analysis of the Industrial Property Code. In turn, the study of the international legal regime, focused on the Convention of the Paris Union for the Protection of Industrial Property, the Madrid Agreement concerning the Repression of False or Deceptive Indications of Source, the Lisbon Agreement for the Protection of Appellations of Origin and Their International Registration and Agreement of Intellectual Property Rights related to Trade. Getting thus an overview of the protection granted to appellation of origin. At a later stage, the work has focused on studying the law applicable to the wine sector, which has been addressed in DL Nº 212/2004, establishing the institutional organization of the wine sector, DL nº 213/2004 establishing sanctions for offences in the wine sector, Regulation (EC) Nº 1493/1999, on organization of the wine market and amending Regulation (EC) Nº 479/2008 responsible for reforming the wine sector. Finally, it addresses the status of the “Vinho Verde” Demarcated Region which defines the rules for “Vinho Verde”.
